利用規約

本利用規約（以下「本規約」）は、CloudCrowd（以下「当方」）が提供するPicSche（以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただく前に、必ず本規約をお読みください。
【第1条：規約への同意】
1. ユーザーは、本アプリを利用することにより、本規約の全ての条項に同意したものとみなされます。
2. 本規約に同意いただけない場合は、本アプリをご利用いただけません。
3. 未成年者が本アプリを利用する場合は、保護者の同意が必要です。
【第2条：本アプリの概要】
本アプリは、画像（学校のプリント、イベントチラシ等）から予定情報をAIによって自動抽出し、ユーザーのiOSカレンダーに登録する機能を提供します。
画像抽出時に「カスタマイズ欄」で入力した内容は、AI解析サービスに送信されます（500文字まで）。個人情報や機密情報を入力しないようご注意ください。無料プランの利用回数は当方のサーバーで管理しており、端末識別用のIDを送信します。
【第3条：提供条件】
1. 本アプリの利用には、以下が必要です：
・iOS 18.0以降を搭載したiPhone
・インターネット接続環境
・カメラ・写真・カレンダーへのアクセス許可
2. 本アプリは、画像から予定を抽出するために外部のAI解析サービス（Anthropic Claude、OpenAI GPT-4o、Google Gemini のいずれか、または当方が運用するAPI経由の Vertex AI）を利用するため、オフライン環境では使用できません。
【第4条：利用料金】
1. 本アプリは、以下の料金体系で提供されます：
・無料版：初回インストール時のみ2回まで、画像解析機能を無料で利用可能。クレジットカード登録不要。使い切ったらチャージ購入で回数を追加できます。
・3回チャージ：3回分の利用権を100円（税込）で購入。有効期限なし（いつでも使える・繰越可能）。複数回購入可能で残高が積み上がります。
・5回チャージ：5回分の利用権を150円（税込）で購入。有効期限なし（いつでも使える・繰越可能）。複数回購入可能で残高が積み上がります。
2. チャージの購入は、App Store経由で行われ、Apple Inc.の利用規約が適用されます。返金については、Apple Inc.のポリシーに従います。
【第5条：禁止事項】
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません：
1. 違法な目的での利用
2. 第三者の権利（著作権、肖像権、プライバシー権等）を侵害する画像の使用
3. 本アプリの機能を不正に操作・改変する行為
4. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル
5. 大量のリクエストを送信し、サーバーに過度な負荷をかける行為
6. 他のユーザーや第三者に迷惑をかける行為
7. 公序良俗に反する行為
【第6条：免責事項】
1. AI解析の精度について
本アプリは高精度なAI解析を提供するよう努めていますが、100%の正確性を保証するものではありません。抽出された予定の日時・内容は、必ずユーザー自身でご確認ください。
2. 予定登録の誤りによる損害
本アプリの利用により、誤った予定がカレンダーに登録された場合でも、それによって生じた損害（予定の見落とし、約束の失念等）について、当方は一切の責任を負いません。
3. サービスの中断・停止
以下の場合、予告なく本アプリのサービスを中断・停止することがあります：
・システムメンテナンスを行う場合
・外部AI解析サービスの障害が発生した場合
・天災、停電、通信障害等の不可抗力が発生した場合
これらによる損害について、当方は責任を負いません。
4. データの消失
本アプリは、ユーザーデータをサーバーに保存しません。iOSカレンダーに登録された予定の管理はユーザーの責任で行ってください。
5. 第三者サービス
本アプリは、画像から予定を抽出するために、外部のAI解析サービスを利用しています。同サービスの障害・変更により本アプリが正常に動作しなくなった場合でも、当方は責任を負いません。
【第7条：知的財産権】
1. 本アプリに関する著作権、商標権、その他の知的財産権は、すべて当方に帰属します。
2. ユーザーは、本アプリの利用権を取得するのみであり、本アプリの所有権を取得するものではありません。
3. ユーザーが本アプリにアップロードした画像の著作権は、ユーザーに帰属します。ただし、画像は解析後直ちに削除され、当方はこれを保存しません。
【第8条：プライバシー】
本アプリにおける個人情報の取り扱いについては、別途定める「プライバシーポリシー」をご確認ください。
【第9条：規約の変更】
1. 当方は、以下の場合に、ユーザーの同意を得ることなく本規約を変更できるものとします：
・変更がユーザーの一般の利益に適合する場合
・変更が本アプリの目的に反せず、変更の必要性、変更後の内容の相当性等に照らして合理的である場合
2. 本規約を変更する場合、変更後の規約の効力発生日の7日前までに、アプリ内またはウェブサイトで告知します。
3. 変更後の規約は、効力発生日以降にユーザーが本アプリを利用した時点で、同意したものとみなされます。
【第10条：利用停止】
ユーザーが本規約に違反した場合、当方は事前通知なく、当該ユーザーの本アプリの利用を停止することができます。
【第11条：サービスの終了】
1. 当方は、30日前までにアプリ内で告知することにより、本アプリのサービス提供を終了することができます。
2. サービス終了により生じた損害について、当方は責任を負いません。
【第12条：準拠法】
本規約は、日本法に準拠し、日本法に従って解釈されます。
【第13条：分離可能性】
本規約のいずれかの条項が無効または執行不能と判断された場合でも、他の条項の有効性および執行可能性には影響しません。

These Terms of Service ("Terms") set forth the conditions for use of PicSche (pronounced "Pikuske"; "this app") provided by CloudCrowd ("we"). Please read these Terms before using the app.
Article 1: Agreement to Terms
1. By using this app, you are deemed to have agreed to all provisions of these Terms.
2. You may not use this app if you do not agree to these Terms.
3. Minors must obtain parental consent before using this app.
Article 2: App Overview
This app automatically extracts schedule information from images (e.g., school handouts, event flyers) using AI and registers it to your iOS calendar.
Content you enter in the "customization" field when extracting is sent to the selected AI provider (up to 500 characters). Please do not enter personal or confidential information. Free-tier usage is managed on our server; we send a device identifier.
Article 3: Requirements
1. Use of this app requires:
・iPhone with iOS 18.0 or later
・Internet connection
・Access permission for camera, photos, and calendar
2. This app uses an external AI analysis service (Anthropic Claude, OpenAI GPT-4o, Google Gemini, or Vertex AI via an API we operate) to extract schedules from images and cannot be used offline.
Article 4: Fees
1. This app is offered under the following pricing:
・Free: 2 free uses, available upon first install. No credit card required. After use, you can add more by purchasing a charge.
・3 Uses Charge: 3 uses for ¥100 (tax included). No expiry; use anytime. Multiple purchases allowed; balance accumulates.
・5 Uses Charge: 5 uses for ¥150 (tax included). No expiry; use anytime. Multiple purchases allowed; balance accumulates.
2. Charge purchases are made through the App Store and are subject to Apple Inc.'s terms. Refunds follow Apple Inc.'s policy.
Article 5: Prohibited Acts
Users must not:
1. Use the app for illegal purposes
2. Use images that infringe on third-party rights (copyright, portrait rights, privacy, etc.)
3. Unauthorized modification or manipulation of the app
4. Reverse engineering, decompilation, or disassembly of the app
5. Sending excessive requests that overload servers
6. Causing nuisance to other users or third parties
7. Acts against public order and morals
Article 6: Disclaimer
1. AI Analysis Accuracy
We strive to provide accurate AI analysis but do not guarantee 100% accuracy. Please verify extracted dates and content yourself.
2. Damages from Incorrect Registration
We assume no liability for damages (missed appointments, forgotten commitments, etc.) arising from incorrect calendar registration.
3. Service Interruption
We may suspend or discontinue the service without notice in cases of maintenance, external AI analysis service failure, force majeure, etc. We assume no liability for such damages.
4. Data Loss
We do not store user data on servers. Management of calendar events is the user's responsibility.
5. Third-Party Services
This app uses an external AI analysis service to extract schedules from images. We assume no liability if the app fails to function due to service failure or changes.
Article 7: Intellectual Property
1. All intellectual property rights in this app belong to us.
2. Users obtain only the right to use the app, not ownership.
3. Copyright in images uploaded by users belongs to the user. Images are deleted immediately after analysis and are not stored.
Article 8: Privacy
Please refer to our separately stated "Privacy Policy" for handling of personal information.
Article 9: Changes to Terms
1. We may change these Terms without consent when the change benefits users generally or is reasonable in light of necessity and appropriateness.
2. We will notify users in-app or on our website at least 7 days before changes take effect.
3. Use of the app after the effective date constitutes agreement to the revised Terms.
Article 10: Suspension
We may suspend a user's access without prior notice if the user violates these Terms.
Article 11: Service Termination
1. We may terminate the service with at least 30 days' notice in the app.
2. We assume no liability for damages resulting from service termination.
Article 12: Governing Law
These Terms are governed by and construed in accordance with the laws of Japan.
Article 13: Severability
If any provision is found invalid or unenforceable, the validity of other provisions remains unaffected.
